Welcome to Moments by Rumah Patingan("Moments", "we", "our", or "us").

These Terms & Conditions ("Terms") govern your access to and use of the Moments platform, website, applications, services, and related features (collectively referred to as the "Service").

By creating an account, purchasing a package, accessing, or using Moments, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with these Terms, please do not use our Service.

1. About Moments

Moments is a digital event memory platform that allows event organisers to collect photos and memories from guests through a QR code-based photo upload experience.

The Service enables users to:

• Create event galleries
• Generate event QR codes
• Allow guests to upload photos
• Manage event memories
• Download collected photos
• Share private event galleries

Moments is designed for events including but not limited to:

• Weddings
• Corporate events
• Celebrations
• Graduations
• Government events
• Festivals
• Private gatherings
• Community events

2. Definitions

For the purpose of these Terms:

• "Account" means a registered user profile created to access Moments.
• "User" means any person who creates an account or uses the Service.
• "Event Owner" means the person or organisation who creates and manages an event.
• "Guest" means a person who accesses an event gallery and uploads photos.
• "Content" means any photos, videos, images, text, files, or materials uploaded to Moments.
• "Gallery" means the digital collection of photos and media created for an event.
• "Package" means the purchased Moments service plan selected by the User.

3. Account Registration

To use certain features of Moments, you must create an account.

When creating an account, you agree to:

• Provide accurate and complete information.
• Maintain updated account information.
• Keep your login credentials confidential.
• Notify us immediately if you suspect unauthorised access.

You are responsible for all activities performed through your account.

You must not:

• Create an account using false information.
• Use another person's account without permission.
• Attempt to gain unauthorised access to other accounts.

4. User Eligibility

By using Moments, you confirm that:

• You are legally capable of entering into this agreement.
• The information provided is accurate.
• Your use of the Service complies with applicable laws.

If you are using Moments on behalf of an organisation, you confirm that you have authority to represent that organisation.

5. Event Creation and Management

Event Owners are responsible for managing their events. This includes:

• Providing accurate event details.
• Sharing QR codes appropriately.
• Managing gallery access.
• Ensuring guests understand how their uploaded content will be used.

Moments does not control how Event Owners distribute access to their galleries. Event Owners are responsible for ensuring they have obtained appropriate permission from guests before collecting photos.

6. Guest Uploads and Content

Guests may upload photos and other content through event galleries.

By uploading content, users confirm that:

• They own the content or have permission to upload it.
• The content does not violate another person's rights.
• The content complies with these Terms.

Users must not upload:

• Illegal content.
• Copyright-infringing material.
• Content containing unlawful activities.
• Content intended to harass, threaten, or harm others.
• Explicit or inappropriate material.
• Private information belonging to others without permission.

7. Ownership of Content

Users retain ownership of content uploaded to Moments.

Moments does not claim ownership of:

• Photos
• Videos
• Event memories
• User-created content

By using Moments, you grant us a limited permission to:

• Store uploaded content.
• Process content necessary to provide the Service.
• Display content to authorised users.
• Deliver requested features.

This permission exists only for operating and improving the Service. We do not sell, license, or commercially distribute your uploaded content without your permission.

8. Platform Ownership

All rights relating to Moments, including:

• Software
• Website design
• Branding
• Logos
• Interfaces
• System architecture
• Features

are owned by Rumah Patingan unless otherwise stated.

Users may not:

• Copy the platform.
• Reverse engineer the software.
• Modify or reproduce the Service.
• Create competing products using our intellectual property.

9. Packages and Payments

Moments offers different packages based on event requirements. Package details may include:

• Number of guests
• Gallery availability period
• Storage duration
• Features included

Prices displayed on the website are subject to change. Payment must be completed before access to paid features is activated.

10. Payment Processing

Payments may be processed through third-party payment providers. We do not store complete payment information such as:

• Credit card numbers
• Security codes

Payment providers process transactions according to their own security policies. You agree that:

• Payment information provided is accurate.
• You are authorised to use the selected payment method.
• You are responsible for applicable charges.

11. Refunds and Cancellations

Due to the digital nature of Moments services, payments are generally non-refundable once the service has been activated. This includes situations where:

• An event has been created.
• A QR code has been generated.
• Gallery access has been provided.
• Digital services have been delivered.

Refund requests may be considered under exceptional circumstances, including:

• Duplicate payments.
• Technical failure preventing service usage.
• Service delivery issues caused by Moments.

Refund requests must be submitted within 7 days from purchase date. All refund decisions are made at the discretion of Moments.

12. Gallery Storage and Expiration

Each package includes a specific gallery availability period. Examples:

• 30 days
• 90 days
• 1 year

After the expiry period:

• Gallery access may be disabled.
• Content may be removed.
• Recovery may not be possible.

Users are responsible for downloading important content before expiry. Additional storage extensions may be available for purchase.

13. Service Availability

We aim to provide a reliable and secure platform. However, we do not guarantee that the Service will always be:

• Available without interruption.
• Error-free.
• Completely secure against all possible threats.

Temporary interruptions may occur due to:

• Maintenance.
• Infrastructure issues.
• Third-party service failures.
• Events beyond our control.

14. Security

We take reasonable measures to protect user information and content. Security measures may include:

• Secure authentication.
• Encryption.
• Access controls.
• Monitoring.
• System protection.

However, no online service can guarantee absolute security. Users are responsible for maintaining secure account access.

15. Prohibited Use

Users must not:

• Attempt to hack or disrupt the Service.
• Upload malicious files.
• Introduce viruses or harmful code.
• Attempt unauthorised access.
• Abuse system resources.
• Use the platform for illegal activities.

Violation may result in:

• Account suspension.
• Account termination.
• Removal of content.
• Legal action where necessary.

16. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms.
• Abuse the Service.
• Conduct fraudulent activities.
• Threaten platform security.
• Upload prohibited content.

Where appropriate, users may be notified before termination.

17. Third-Party Services

Moments may integrate with third-party services including:

• Payment providers.
• Cloud storage providers.
• Email providers.
• Analytics providers.

We are not responsible for interruptions caused by third-party providers.

18. Limitation of Liability

To the maximum extent permitted by law, Moments shall not be responsible for:

• Loss caused by user actions.
• Unauthorised sharing of event links.
• Guest misuse.
• Accidental deletion caused by users.
• Failure to download expired content.
• Third-party service interruptions.

Users are responsible for maintaining backups of important content.

19. Indemnification

You agree to protect and hold harmless Moments, Rumah Patingan, and its representatives from claims, damages, losses, or expenses arising from:

• Your use of the Service.
• Your uploaded content.
• Your violation of these Terms.
• Your violation of another person's rights.

20. Privacy

Your privacy is important to us. Your use of Moments is also governed by our Privacy Policy. By using Moments, you acknowledge that you have read and accepted our Privacy Policy.

21. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on our website. Continued use of Moments after changes means you accept the updated Terms.

22. Governing Law

These Terms shall be governed by and interpreted according to the laws of Malaysia. Any disputes relating to these Terms shall be subject to the jurisdiction of Malaysian courts.
